RENTAL AGREEMENT
This Camera Kit Rental Agreement (“Agreement”) is entered into between The Wedding Preserve, LLC, a Georgia limited liability company (“Lessor”), and the customer completing a booking, signing electronically, or otherwise accepting these terms (“Lessee”).
By placing an order, making payment, checking an acceptance box, or electronically signing this Agreement, Lessee agrees to be bound by all terms contained herein.
RENTAL OF EQUIPMENT
Lessor agrees to rent to Lessee the equipment listed on the applicable order, invoice, booking confirmation, or package description (“Equipment”).
All Equipment remains the sole property of Lessor at all times.
RENTAL PERIOD
The rental period begins upon confirmed delivery of the Equipment and ends on the return shipment date specified in Lessee’s booking confirmation.
Equipment must be returned using the prepaid shipping label provided by Lessor unless otherwise authorized in writing.
CUSTOMER RESPONSIBILITY
Lessee accepts full responsibility for the Equipment from the time of delivery until received and inspected by Lessor.
Lessee agrees to:
Use Equipment carefully and according to provided instructions.
Keep Equipment secure at all times.
Prevent unauthorized use.
Protect Equipment from theft, water damage, impact damage, extreme temperatures, and misuse.
LOSS, THEFT, OR DAMAGE
Lessee is financially responsible for any loss, theft, destruction, or damage occurring during the rental period.
Lessor may charge Lessee’s payment method on file for:
Repair costs
Replacement costs
Cleaning fees
Shipping costs
Collection costs
Loss-of-use fees
If Equipment is damaged beyond economical repair or not returned, Lessee agrees to pay the full replacement value.
Replacement values shall be determined by Lessor using current market replacement cost.
AUTHORIZATION TO CHARGE PAYMENT METHOD
Lessee expressly authorizes Lessor to charge any payment method provided by Lessee for:
Outstanding balances
Late fees
Repair costs
Replacement costs
Cleaning fees
Shipping charges
Collection costs
Chargeback costs
Attorney’s fees where permitted by law
LATE RETURNS
Equipment not shipped back by the required return date (two days after wedding) will incur a late fee of $100 each day overdue.
Lessor reserves the right to charge additional loss-of-use fees resulting from future bookings impacted by a late return.
DELIVERY AND SHIPPING
Lessor will make commercially reasonable efforts to deliver Equipment before the event date.
Lessor is not responsible for delays caused by:
Weather
Carrier delays
Natural disasters
Labor disruptions
Government actions
Events outside Lessor’s control
INSPECTION AND REPORTING
Lessee must inspect Equipment upon receipt.
Any missing items, defects, or operational concerns must be reported within twenty-four (24) hours of delivery.
Failure to report issues within this period creates a presumption that Equipment was delivered in working condition.
NO GUARANTEE OF FOOTAGE
Lessor provides equipment only.
Lessor does not guarantee:
Recording quality
Quantity of footage
Successful operation by users
Preservation of recordings
Specific artistic results
Lessee assumes all risk associated with recording activities.
LIMITATION OF LIABILITY
Lessor’s total liability arising from this Agreement shall never exceed the total amount paid by Lessee for the applicable rental.
Under no circumstances shall Lessor be liable for:
Lost footage
Lost memories
Missed recordings
Emotional distress
Lost profits
Consequential damages
Special damages
Incidental damages
INDEMNIFICATION
Lessee agrees to defend, indemnify, and hold harmless Lessor and its owners, officers, employees, contractors, and agents from any claims, damages, liabilities, costs, and attorney’s fees arising from:
Use of Equipment
Possession of Equipment
Transportation of Equipment
Violation of law
Injury to persons
Damage to property
CANCELLATION POLICY
All cancellation and refund terms shall be governed by the package purchased and any published cancellation policy in effect at the time of booking.
MEDIA RELEASE AND MARKETING CONSENT
By purchasing any package or service from The Wedding Preserve, Lessee grants Lessor a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, edit, publish, display, distribute, and create derivative works from any video, audio, photographs, or other content captured using the Equipment for marketing, advertising, promotional, social media, website, portfolio, educational, and business purposes. Lessee represents that Lessee has obtained any necessary permissions from participants appearing in such content. Lessee waives any right to inspect or approve the finished use of such content and releases Lessor from any claims arising from the authorized use of such materials.
ATTORNEY’S FEES
In any action arising from this Agreement, the prevailing party shall be entitled to recover reasonable attorney’s fees and costs to the extent permitted by law.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Georgia without regard to conflict-of-law principles.
VENUE
Any legal action arising from this Agreement shall be brought exclusively in a court of competent jurisdiction located in Georgia.
ELECTRONIC SIGNATURES
Electronic acceptance, electronic signatures, and digital acknowledgements shall have the same force and effect as original handwritten signatures.
SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
ENTIRE AGREEMENT
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions, communications, and understandings relating to the rental of Equipment.
BY ACCEPTING THIS AGREEMENT, LESSEE ACKNOWLEDGES THAT LESSEE HAS READ, UNDERSTOOD, AND AGREES TO BE BOUND BY ALL TERMS AND CONDITIONS.
